Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the JiuMe (揪Me) group-buy ordering app and website (the “Service”), operated by JiuMe (“we”, “us”).

Please read these Terms carefully. By creating an account or using the Service, you agree to be bound by them. If you do not agree, do not use the Service.

1. Acceptance of Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization.

2. Eligibility

You must be at least 13 years old (or 16 where required by local law) to use the Service. By using it, you represent that you meet this requirement and that the information you provide is accurate.

3. Accounts and Security

  • You are responsible for the activity that happens under your account and for keeping your login credentials confidential.
  • You agree to provide accurate account information and to keep it up to date.
  • Notify us promptly if you believe your account has been accessed without authorization.
  • Customer and merchant accounts are distinct; an account cannot be both, and you may not be able to switch types later.

4. Acceptable Use

When using the Service, you agree not to:

  • Break any applicable law or regulation, or infringe anyone's rights.
  • Upload content that is unlawful, infringing, deceptive, harmful, or that you do not have the right to share.
  • Upload menu photos or images you do not own or have permission to use.
  • Attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the Service or its systems.
  • Use the Service to send spam, or to harass or impersonate others.
  • Misuse the automated request limits or otherwise interfere with other users' use of the Service.

5. Group Orders and Merchant Orders

  • OrganizersIf you start a group order, you are responsible for the order details, for setting the cutoff, for locking the order, and for any arrangement you make with the store regarding payment, pickup, or delivery.
  • ParticipantsWhen you join an order, you are responsible for the items and notes you submit, including any allergy or dietary information.
  • MerchantsIf you operate a store, you are responsible for the accuracy of your catalog, prices, availability, and contact details, and for fulfilling orders you accept. You must keep the required business and contact information accurate.
  • TransactionsJiuMe is a coordination tool. Unless we expressly state otherwise, JiuMe is not a party to any transaction between organizers, participants, and stores, does not process payments, and is not responsible for the goods provided by a store.

6. User Content

“User Content” means anything you submit to the Service, including menu photos, store and item images, order details, names, notes, and feedback.

You retain ownership of your User Content. You grant JiuMe a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, and display your User Content solely to operate, provide, and improve the Service (for example, sending a menu photo for text recognition, or showing your order to the organizer and store). This license ends when you delete the content or your account, except for copies retained as required by law or kept in routine backups for a limited period.

You represent that you have the necessary rights to your User Content and that it does not violate these Terms or any law.

7. Intellectual Property

The Service, including its software, design, logos, and the “JiuMe” / “揪Me” name, is owned by JiuMe or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works from the Service except as permitted by these Terms or applicable law.

8. AI Recognition and Food Information

  • AI text recognition may be inaccurateMenu items, prices, and other details detected from photos are produced by automated optical character recognition and may be wrong or incomplete. Always review and correct detected items before relying on them.
  • Food and allergy information is user-providedItem names, customizations, and allergy or dietary notes come from users and stores, not from JiuMe. They are not a substitute for confirming ingredients, allergens, and preparation directly with the store. If you have a food allergy or dietary restriction, confirm with the merchant before consuming any item. JiuMe is not responsible for the accuracy of food or allergy information.

9. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any information obtained through it (including AI-detected menu data) is accurate or reliable.

10. Limitation of Liability

To the maximum extent permitted by law, JiuMe and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us, if any, in the twelve months before the claim, or USD 100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. Provisions that by their nature should survive termination — including User Content licenses for retained copies, disclaimers, and limitations of liability — will survive.

12. Changes to the Service or Terms

We may modify the Service or these Terms from time to time. When we make material changes to the Terms, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which JiuMe operates, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located there, except where mandatory consumer-protection laws of your place of residence provide otherwise.
